The Securities and Exchange Board of India (SEBI) has announced that clients can now use the value of shares delivered through early pay-in (EPI) toward margin requirements on subsequent buy and sell positions in the cash market. The regulatory change aims to ease margin requirements for trades undertaken on the same day.
Under the updated framework, clearing corporations will not collect margins from trading or clearing members on a client's subsequent buy or sell positions, up to the value of securities for which the early pay-in request has been accepted. This facility will apply specifically when a client has a net sell obligation in a settlement.
The regulatory decision follows proposals submitted by the Broker Industry Standards Forum (ISF) and recommendations from SEBI's Risk Management Review Committee (RMRC), alongside internal deliberations by the market regulator.
Early pay-in refers to the delivery of securities to the clearing corporation prior to the prescribed settlement deadline. While existing guidelines already allowed the value of shares delivered through EPI to count toward margin requirements for sale transactions and subsequent positions, the new framework outlines a specific calculation method.
On the trade date, the clearing corporation will calculate the available EPI value, which will be determined as the lower of the value of the early pay-in made and the value of securities sold. When a client takes a position in the cash segment on the same day using this EPI benefit, the clearing corporation will evaluate the client's available margin after reducing the available EPI value.
However, specific conditions apply if positions change. If the client squares off the sale position in securities for which the EPI benefit was utilized, the EPI value will be removed. Any resulting margin shortfall at the client level will then be blocked from the trading or clearing member's proprietary collateral. SEBI noted that this particular condition will not apply to trade-for-trade securities, as those transactions are settled on a gross basis.
In addition to these provisions, SEBI has instructed trading members to update their risk management systems. These systems must ensure that clients are only permitted to square off positions backed by EPI or take new positions when the requisite client margins are officially available with the trading member.
Clearing corporations are required to make the necessary changes to their internal rules and systems and publish the circular on their respective websites. The provisions outlined by the regulator will officially come into force four months from the date of issuance of the circular.
"SEBI's decision to allow early pay-in values toward margin requirements is a practical step that brings operational relief to cash market participants. By streamlining how clearing corporations calculate available EPI values on the trade date, the regulator is addressing structural bottlenecks raised by the Broker Industry Standards Forum. However, trading members will need to carefully adapt their risk management systems over the next four months to handle margin shortfalls and compliance effectively." — Dr. Shishir Gupta, Founder & CEO, StartupLanes
