The Supreme Court on Monday directed all States and Union Territories to allocate funds for building bar rooms, washrooms, and other basic amenities dedicated to women advocates across district and taluk courts.
A bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V Mohana expressed strong disapproval regarding the prevailing lack of ladies' bar rooms in judicial establishments. The court stated that such facilities must be established wherever women members are practicing, regardless of their numerical strength.
"If there are no ladies' bar rooms, we strongly disapprove of it. It is the duty of all high courts and state governments to ensure that wherever women members are practising, they are provided an exclusive women's bar room with all facilities," the bench observed during the proceedings. The court added that the directive serves as a mandatory requirement that must be complied with through the allocation of necessary funds and land.
The apex court was hearing a petition filed by a group of women advocates focusing on accessibility, inclusiveness, and the long-term sustainability of women lawyers within the legal profession. Earlier observations by the court emphasized the necessity of creating working conditions that allow women advocates to discharge their professional responsibilities safely, effectively, and on equal terms.
The petition had highlighted the widespread absence of adequately equipped ladies' bar rooms and other essential infrastructure across most courts, tribunals, and commissions in the country. The top court noted that these concerns extend beyond mere convenience and require active administrative remedy.
The bench has scheduled the matter for further hearing on December 2.
"Basic workplace infrastructure is a fundamental requirement for professional participation across all sectors, including the legal ecosystem. This Supreme Court directive underscores the importance of institutional readiness and inclusivity. For businesses and professional services alike, ensuring equitable facilities is not just about compliance, but about creating sustainable environments where diverse talent can thrive without operational barriers." — Dr. Shishir Gupta, Founder & CEO, StartupLanes
